Wills and Estate Lawyers

Our highly reputed Wills and Estate Lawyers can advise you in all aspects of wills, estates and succession planning.

We provide legal services encompassing Estate Planning, Estate Administration and Estate Litigation.

Our estate lawyers take the time to get to know you, each member of your family and any other stakeholders to ensure we understand your situation and implement the best solution for your circumstances.

Estate Planning

Estate planning is not just about creating a will – it’s a process that focuses on all the financial affairs of a family and their ongoing interests.

Effective estate planning involves implementing a plan that meets your individual needs, protects your interests and minimises potential taxes and fees.

To ensure your estate is administered in the manner you have chosen and to avoid unnecessary complications, it is important to seek professional advice if you intend making a will or updating your estate planning. There are many objectives to be accomplished through the execution of a will, such as:

  • The appointment of an executor, ensuring controlled distribution of assets, which enables and obliges a person’s executor to distribute the person’s assets according to their wishes
  • Guardianship arrangements for minor children
  • Business arrangements which ensure the continuation of a business until a buyer can be found or other arrangements made
  • GST considerations for the estate
  • Religious obligations.
We draft realistic and comprehensive legal documents for the smooth transition of your assets, including real estate, business assets, shares, superannuation, life insurance and personal effects.  Our experienced Wills & Estates team is experienced in the preparation of simple to complex wills tailored to your needs.

Clewett Lawyers can also facilitate the safe keeping of your original will, and other personal documents, at no additional cost.

Estate Administration

Clewett Lawyers Wills and Estates team can act in the administration of deceased estates in accordance with the deceased’s will. This may involve obtaining probate where it is required and transferring property, shares and other assets to beneficiaries.

Estate Litigation

Our Wills and Estates legal team is also experienced in complex estate dispute matters, including challenging a will (or defending it), claims for inadequate provision in a will, arguments about the mental capacity of the testator when making a will and when the deceased person died intestate.

Our team has a strong focus on dispute resolution, by negotiation or mediation where appropriate, while being sensitive to the stresses on the parties involved in difficult times.

Family Lawyers

Family law is a highly emotional and usually very complex area of law. There are many aspects within family law but the more common are resolving financial matters and sorting out suitable arrangements for the children after separation or divorce.

We are experienced Toowoomba-based Family Lawyers

Our Toowoomba-based team of family lawyers has more than 30 years of experience. We have a strong reputation for a solution-focused approach to all legal cases involving married and de facto couples living all over the Darling Downs region, as well as Warwick and Stanthorpe.

At Clewett Lawyers, our focus is on helping people.  Whether you are separated, divorced, or thinking about separating, our Family Lawyers are here to help you.

Our family lawyers understand the impact that family disputes can have on your life. We also appreciate that the legal process can be overwhelming during these difficult times. We encourage communication rather than confrontation and we always consider the needs of the whole family, particularly children.

Our Approach with Family Law Cases

Our Family Lawyers have expertise in negotiation, mediation, litigation and advocacy.  We will usually explore alternatives to litigation such as mediation, skillful negotiation, or an out of court agreement such as a Binding Financial Agreement or Consent Orders.

However, some cases simply cannot be resolved out of court, so in these cases, we will not hesitate to go to court to defend and protect the best interests of our clients.

We will deal with your case in a sensitive and professional manner.  We will provide clear and compassionate advice so that you can make fully informed choices. And we will keep you informed of developments in your case.

We can also help if you are

  • Entering into a new relationship and wish to protect your assets should the relationship fail;
  • A grandparent, relative or friend who is concerned about the welfare of children, or
  • A third party (business partner, relative, friend, creditor) affected financially by a separation.

Aged Rights (Elder Law)

As we age, we are confronted with decisions that can impact our quality of life, dignity, financial security and relationships. Some of the more complex decisions present legal issues that require a lawyer with specialist expertise and experience in the area of aged rights (also known as elder law). There are few in our community more vulnerable than the elderly, especially those in the care of a nursing home or other aged care facility. Our highly trained and experienced aged rights lawyers will provide clear and compassionate advice on all elements of aged care law.

Elder Law Advice

We provide Elder Law advice to the elderly and their families on:

  • Administration of estates & deceased estates
  • Estate disputes & litigation
  • Social security
  • Family law, including grandparents’ rights
  • Retirement village and residential aged care transactions

Preventing Elder Abuse

With a strong community background, Clewett Lawyers are committed to the prevention of what is commonly called ‘Elder Abuse’.  Elder Abuse is where an ageing person is taken advantage of because of their age related vulnerability.  It may also be where an older person experiences physical or emotionally abuse. While there aren’t any firm statistics on elder abuse in the community, various international studies have suggested that between 5 and 20% of people over the age of 65 experience abuse. Planning ahead is the main preventative strategy for preventing elder abuse in the community. There are an increasing number of resources available on Elder Abuse, and the prevention of it, and we will continue to update our resources to provide further information for the community and community organisations.
